The Way It Will Be?
This is the "Standard of Practice" for California as it appears to be set out by this Decision of Administrative Law Judge Ruth Astle and accepted by the Medical Board of California on August 4, 1998
Judge Astle said (Page 22, Decision) "This case is essentially about setting appropriate limits of medical practice in California at the "fringes" of medicine."


This disciplinary decision will become a precedent in California, and potentially in other states, unless prevented at the November 6, 1998 "Reconsideration Hearing."

A physician shall not be permitted to diagnose or treat Multiple Chemical Sensitivity, Chronic Fatigue Syndrome, or Candidiasis.

Proper treatment for the above symptoms is only permitted to be psychotherapy, because these are diseases that don't exist.

A physician shall not be permitted to use or suggest dietary intervention for ADHD or Autism.

EPD (allergy treatment) for any condition will become unavailable. Preparation of the enzyme/allergen mix according to the EPD protocol has been declared to be "adulteration" of a drug. EPD itself has been specified in the Decision (Parag. 81, Page 21) as one of the "unproven, disproven and potentially harmful diagnoses and treatments."

Candida is not allowed to cause symptoms of any kind except at the 2 ends = mouth & bottom.

Oral antifungal treatments are not allowed except in a documented systemic condition, such as may happen in AIDS.

IgG Food & Mold MAST Tests are not considered appropriate tests for allergies, according to the Medical Board.

It is not appropriate to test for allergy to cigarette smoke or auto exhaust.

Testing a child with ADHD for allergies is not appropriate.

Allergies are not related to ADHD or any behavioral problems.

Appropriate treatment for a parent who does not want to use drugs for ADHD is to refer them for counseling.

A physician can be blamed for the suicide of a patient he has not seen for over 2 years.

If a physician tries a medicine or diet "to see if it helps" but is not sure and wants to stop it to see if there is a change, he or she had better get an IRB and have the patient sign the California Bill of Rights form, because this is human experimentation. (Pg. 22)

If a physician tries a medicine or diet and it does help, but he or she does not stop it sometimes "to consider its efficacy," this is "clearly excessive prescribing." (Pg. 14)
It was overheard "off the record" during the hearings that this was intended to be a "model" trial -- to make it easier to do the same to other doctors everywhere . . . especially doctor who read new research and use or develop innovative treatments of any type.

We want to fight this ruling, so that treatments listed above, among others, will be available for patients. And so that this case will not become the precedent that deprives countless other physicians of their licenses.

To fight the ruling will take an enormous amount of money. We estimate the appeal process to cost over $200,000. Our goal now is to raise $100,000 by the end of 1998.

A Medical Defense Fund has been set up to raise this money. We, in the Defense Fund, are volunteers. With minimal administrative costs and no salaries, all money collected goes to pay legal expenses and related costs.
